Like Hell It Doesn’t Matter That Prop 8 Trial’s Judge Walker Is Gay
What’s that famous quote by William Shakespeare? Umm…oh yes. “The lady doth protest too much, methinks.” That’s the one. It fits the following scenario perfectly.
Un–frigging—believable. We wake up this morning and check our email which revealed to us a slew of posts across the LGBT blogosphere with these ridiculous headlines about how it doesn’t matter that Prop 8 trial judge Vaughn Walker is gay. Are these people on drugs? Of course it matters!
If it didn’t matter then why the hell is the LGBT blogging community tripping over each other to write a post about Judge Walker being outed by the San Francisco Chronicle this weekend—–then only to breathlessly follow that up with the disclaimer in the title of their posts—–But, well, you know, it doesn’t matter. BULLSHIT. And these jive bloggers know it. Oh hell to the yes—- it most certainly does matters.
Ask the defenses lead counsel Andrew Pugno on the down-low. He’ll be more than willing to tell you just how much it matters.
Just like a black judge would have mattered to blacks in waiting for a ruling to be handed down in previous groundbreaking Supreme Court cases that heavily impacted African Americans. It most certainly would’ve in the Loving vs. Virginia case had it been the court of a lone African American judge. And don’t get us wrong—we’re not saying that a black judge would’ve been unable to remain impartial in his profession duties while presiding over a trial impacting the civil rights of blacks. And we’re not saying that Judge Walker is unable to do that, either in a trial impacting the civil rights of the LGBT community. But this ridiculous blabbering that it doesn’t matter is yet again the LGBT blogger community trying to pretend not to know and looking like morons in the hopeless transparency of it all.
It’s like a bad Spike Lee movie these LGBT bloggers act like at times. There’s really no need for this kind of posturing or silliness. It’s embarrassing.
Of course it eefing matters that the goddamn judge is a fag.
Even if only for the psychological impact and high of knowing there is a gay judge who presided over the trial and is making the ultimate decision on this case—it matters. And on the opposite end of that spectrum in terms of the defense——-they’ve already revealed in so many words just how much it matters. Andrew Pugno had this much to say about it in a quote from the SF Chronicle piece:
“In many ways, the sponsors of Prop. 8 have been put at significant disadvantage throughout the case,” Pugno said. “Regardless of the reason for it.”
If we were Pugno we’d be worried, too.

"Does it matter?" is a question that is insufficiently precise, at least inn this matter.
"Is it significant?"
Of course! The fact that a gay man is a judge at this level is significant. Was there a Black judge in a position of similar stature in VA "back then"? Kinda doubt it! I The fact that the California judicial system did not "organize" a gay judge out of presiding over this case is significant. All of that speaks volumes about the progress made to date by LGBT citizens.
"Should it matter?"
Fuck no! One way or another,t he judge in this case is going to be on one side or another. Would anybody raise an eyebrow if the judge were straight? Fuck no! So, STFU about the implications of the judge being gay. Unless he's getting a Monica under his robe while presiding, his sexual preference is not relevant.
"Can he be objective?
A much so as any judge can be. We believe judges honor their commitment to be impartial. Unless you are a paranoid, homophobic, Bible-banging, pulpit-pounding right-winger, you should have no more reason to worry about a gay judge than a straight judge.
"Will his sexual orientation matter in an appellate court?"
It should not. Given the individuals who are the plaintiff's counsel, I have faith they will be able to shoot holes in an effort to raise the fact as an issue. What I don't know is if the appellate court will be objective or if it will have a latent anti-gay predisposition . . . or be populated by Alito-Scalia-Thomas wanna-bees.
