Religious Org Wants Judge Walker To Excuse Himself From Prop 8 Trial
It doesn’t matter if he’s gay, eh? Of course it doesn’t—-for people who don’t have problems with gay judges.
The Liberty Counsel, a non-profit religious and political organization based out of Orlando, Florida, sent out a press statement today demanding that Judge Vaughn Walker recuse himself from the Prop 8 trial. The Liberty Counsel resolutely believes Judge Walker’s sexuality would undoubtedly color his ability to make a sound and unbiased ruling on the case.
We assure you this Judge Walker fan club is just starting to ramp up membership. There will be more to come on the judges sexuality from the freaked out bible thumpers without a shred of doubt.
If you all remember, this past weekend the San Francisco Chronicle outed Judge Walker.

While of course the judge’s sexuality shouldn’t be an issue—nonetheless we knew sooner or later SOMEBODY was going to make an issue of it and loudly at that. Because the bottom line is: it’s not about gay marriage for these folk or religion or the definition of marriage or anything else besides straight up homophobia—no chaser.
While we’ve never heard of the Liberty Council apparently they’re the Southern cousin of the Alliance Defense League—-the folks who bankrolled the legal defense for the Prop 8 trial. Like Alliance Defense League, they’re big—-and have a lotta money. We don’t think that will have any impact on Judge Walker’s status, but if this action on behalf of the Christian Right is any indication of their reaction if Prop 8 is overturned all hell is gonna break loose because these folks and friends will make Judge Walker’s ruling all about his sexuality and nothin’ but. It will be a very interesting to see how this all goes.
We’ll bet all the tea in China some dirt from Judge Walker’s past is going to mysteriously makes it way to the press before it’s all done and over with.
So Mark, if you’re reading this, this is why it matters. We don’t think we need to be any clearer.
We only pray there’s no sex video floating about.

As I said before, I have no doubt that some homo-hater on shaky legal ground will try to use Judge Vaughn Walker's sexual orientation to gain undue leverage on totally irrelevant grounds.
However, as I also pointed out yesterday, in doing so, they are pathetic and two-faced.
After the endless parade of politicians who are card-carrying members of the "hetero horn dog club" . . . SC Gov. Mark Sanford, NV Senator John Ensign, NY Gov. Elliot Spitzer, LA Senator David Vitter, etc., etc., etc (For more fun and bedroom games, see "A Decade of Sex Scandals) http://firstread.msnbc.msn.com/archive/2009/06/24... . . . It's time for LGBT folks and Progressives to tell the "other side" . . . "If your drawers don't zip, you must not flap your lip!"
If you believe being born hetero or homo creates a "vested interest" . . . There is no judge on earth who does not have a "vested interest" in the Prop 8 trial based on the same grounds as Judge Walker. So the argument advanced by Liberty Counsel (Aren't you sick of having right-wingers and "christians" — small "c" intentional — co-opt the word "liberty"?) is utter nonsense. "The Emperor has no clothes . . . The argument has no legal grounds." They are just pissed that there's a homo and not a homo-hater on the bench in this case.
For eight years, right-wingers and evangelicals bastardized the US Department of Justice and its Civil Rights Division in particular. They replaced attorneys who were non-partisan, career professionals with zealots and ideologues from Pat Robertson's diploma mill of a law school at Regent University. In the epitome of paranoid self-importance, they shifted the focus of "civil rights" from racial justice and minority rights to "fighting religious persecution" against their brand of "christians".
So, finding their current grandstanding two-faced and ludicrous is highly justified. It is not surprising that those who would glibly stack the nation's judicial system to advance their narrow special interests would suspect others of an ability to do the same. They abused the public trust and violated their oaths of office, so they think everybody is as sleazy as they are. After all, we each see the world through the eyes of our own heart. So people with evil hearts see evil everywhere . . . and they have no qualms about telling lies to deceive their gullible followers and get what they want . . . The rest of humanity be damned.
Quite frankly, as far as I am concerned, even if they find a video of Judge Walker doing it with a pixie and a pony on a pulpit, that is totally irrelevant to his professional role on the bench. If their is a legal flaw in his rulings or decisions . . . address that. Otherwise, to the homo haters, I say . . . Stay out of the Judge's bedroom . . . After all, you CLAIM to be straight!!
