Tax Equality For Same Sex Couples Intro’d By CA Lawmaker
California Assemblyman Mike Feuer today introduced a resolution that outlines a tax equality provision for same sex couples in the state. The resolution called Assembly Joint Resolution 29, asks that the IRS defer to California law on treatment of community property belonging to registered domestic partners and same-sex spouses. Currently same sex couples and domestic partners must file separate federal tax returns.
In a statement on his Web site, Feuer had this to say:
“This double standard in federal tax filing highlights how important it is to give all committed couples access to marriage rights. As we continue to fight for full equality, we must also ensure that the federal government respects community property rights, which are granted by California to both married couples and domestic partners. In a number of areas, we in California have tried to provide registered domestic partners with as many of the same rights, protections, and benefits of marriage as possible. Further, more than 8,000 same-sex couples are legally married in California, and we must guarantee that their rights are upheld.”
Feuer’s joint resolution seeks tax equity for California resident same-sex couples who have community property arising from their status as registered domestic partners or from their marriages.
